Interesting discussion about swedish organisation STIMIntressant diskussion om STIM

Sweden Rock Festival and the swedish organisation STIM (a royalty collecting company) are having a fight right now. To sum up, SRF think that STIM’s fee for live music are way to high, and that STIM misuse their position as the only royalty collecting organisation in Sweden. STIM on the other hand thinks the SRF generate enough profit by far to pay those fees.

I have of course no idea what’s right here, a court will have to judge. I don’t even know if I have an opinion. If you simplify everthing, I guess SRF is wrong, because the rules and laws are just as they are, even though they might be right in some kind of ethical way.

What one can hope for is at least that this might lead to a constructive discussions about the laws. Because it’s no laws by nature, neither the good nor the bad things with them. And as the human I am, I have of course much easier to point out bad things, rather than the good. So this post might sound somewhat more negative than necessary.

One thing I wonder about is why composers should be payed every time their songs are being performed? This is rare compared with other proffessions, I can’t think of any similar right now. The most common way is to get paid once, and the buyer can use it as much as he or she wants to. Or, that you buy some kind of license which allows you to use the product as you like for a limited time.

An even more intresting thing is of course if it’s a good thing that STIM have a monoply position. If I got it right, they collect money for all music which are played on e.g. the radio. Even though the composer is not a member of STIM. And the only way for the composer to get hold of those money is to join STIM.

But once you are a member, you can’t choose which of your compositions you want STIM to collect royalties for. I, who am a member, can’t as far as I know don’t choose to donate a song for e.g. a commercial for Greenpeace, and tell them that they don’t have to pay any royalty every time the commercial is shown. .

At least not with the actual rules. Of course this can be solved by giving them the music and not tell that I wrote it. But I still think that this show that the rules are kind of stiff?

And again, please don’t missunderstand me. I think STIM in general is a great idea. Music buisness is very different to alot of other buisnesses, and it’s of course a good thing that people who work there get payed. But things are rarely that good that you can’t improve them, right? 🙂

Det finns förutom detta tonvis med artiklar i Ă€mnet, googla (eller vilken sökmotor du nu föredrar) pĂ„ “sweden rock stim” sĂ„ blir det en del trĂ€ffar.

Jag har sĂ„klart ingen aning om vad som Ă€r rĂ€tt eller fel i just detta “mĂ„l”, jag vet inte ens om jag har en Ă„sikt. Ser man krasst pĂ„ det sĂ„ har förmodligen SRF gjort fel med avseende pĂ„ gĂ€llande lagar och avtal, Ă€ven om dom skulle ha rĂ€tt i nĂ„gon slags filosofisk eller moralisk mening.

Det man kan hoppas pÄ Àr kanske att sÄdana hÀr fall leder till en konstruktiv diskussion om de gÀllande lagarna. För det Àr ju verkligen ingen sjÀlvklarhet att vi har de bestÀmmelser som finns just nu, bÄde de bra och dÄliga sidorna med dessa. I god mÀnsklig anda sÄ har jag definitivt lÀttare att se problem/fel/dÄliga saker i nÄgonting Àn att lyfta fram det bra. DÀrför lÄter kanske detta inlÀgg lite mer negativt Àn vad det borde vara.

En sak man kan frÄga sig Àr hur det blivit sÄ att just lÄtskrivare ska ha betalt varenda gÄng deras verk framförs? Det finns sÀkert andra yrkeskategorier med liknande villkor, Àven om jag inte komma pÄ nÄgra. Desto vanligare Àr ju att man sÀljer sin vara till ett fast pris, och sen kan den som köper varan anvÀnda den som hen vill. Alternativt att man köper en licens för att anvÀnda nÄgonting fritt under en viss tid.

Sen Ă€r det sĂ„klart en mycket intressant frĂ„ga om hur vettigt det Ă€r att STIM faktiskt har nĂ„got slags monopol pĂ„ sin verksamhet? Om jag förstĂ„tt det hela rĂ€tt sĂ„ samlar dom in pengar pĂ„ all musik som spelas i t ex radio. Även om kompositören inte Ă€r medlem i STIM. Och enda sĂ€ttet att fĂ„ ut dessa pengar Ă€r att gĂ„ med i STIM.

LÀgg dÀrtill att man inte kan vÀlja vilka av sina verk man till att STIM ska samla in pengarna för. Jag, som Àr medlem i STIM, kan sÄvitt jag vet inte vÀlja att skÀnka en lÄt som jag har skrivit till nÄgot gott syfte, t ex en reklam-film för Greenpeace, och sÀga att dom inte behöver betala nÄgra STIM-pengar för just den musiken.

Inte enligt reglerna i alla fall. Det gÄr sÄklart att komma runt genom att inte ange sig sjÀlv som kompositör. Men jag tycker ÀndÄ att en sÄdan hÀr sak visar att reglerna och bestÀmmelserna kanske inte Àr helt optimala?

MissförstĂ„ mig inte nu. Jag tycker att det Ă€r jĂ€ttebra att STIM finns, musikbranschen Ă€r i allmĂ€nhet ganska olik mĂ„nga andra branscher, och det Ă€r sĂ„klart bra att det finns ett ganska pĂ„litligt sĂ€tt för kompositörer att fĂ„ en inkomst. Men det Ă€r ju sĂ€llan nĂ„gonting Ă€r sĂ„ bra att det inte kan bli bĂ€ttre! 🙂
